This agreement is entered into between Digital Web Hosting and Applications ("Company," "we," or "us") and the individual or entity accessing our services ("Client," "User," or "you"). By using our high-performance hosting platform, applications, or technical support, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you do not agree to these terms, you must immediately cease all use of our services.
2. Services & Account Eligibility
Our services are designed for small businesses and individuals who require enterprise-grade hosting performance. To maintain an account, you must be at least 18 years old and provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Use of Services & Acceptable Use
You agree to use our services only for lawful purposes. Prohibited activities include, but are not limited to: hosting illegal content, distributing malware, initiating DDoS attacks from our infrastructure, sending unsolicited bulk emails (SPAM), attempting to breach our security layers, or infringing upon the intellectual property rights of others. Any violation of our Acceptable Use Policy may result in immediate account termination.
4. Plans, Billing & Payments
Fees for our hosting plans (Buzz, Primetime, Elite, Extreme) are billed in advance on a recurring basis. All payments are non-refundable unless otherwise specified in a specific promotional offer. Failure to pay fees on time will result in account suspension. Digital Web Hosting and Applications reserves the right to modify pricing with 30 days' notice.
5. Uptime, Support & Maintenance
We strive to maintain a 99.9% uptime for all hosting plans. Technical support is provided through our specialist team via ticket, email, or specified channels based on your plan level. Periodic maintenance is required to ensure system integrity; we will endeavor to provide notice for scheduled maintenance that might impact service availability.
6. Data Security & Backups
While we implement elite-grade security protocols, you are ultimately responsible for the backup of your data. We provide automated backup tools as a convenience, but Digital Web Hosting and Applications is not liable for data loss. We recommend all clients maintain independent off-site backups of critical business data.
7. Third-Party Services
Our hosting environment may interface with third-party APIs, software, or services. We do not control these external services and are not responsible for their availability, security, or content. Your use of third-party services is subject to their respective terms and privacy policies.
8. Intellectual Property
Digital Web Hosting and Applications retains all rights to its proprietary hosting technology, software code, website designs, and trademarks. Users retain ownership of the content they upload to our servers; however, you grant us a limited, worldwide license to host, display, and distribute this content solely for the purpose of providing the service.
9. Termination & Suspension
We reserve the right to suspend or terminate your service at our sole discretion, without prior notice, for breach of these Terms, non-payment, or technical necessity. Upon termination, your right to access the services ceases immediately, and any stored data may be deleted according to our data retention policies.
10. Disclaimers & Limitation of Liability
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL WEB HOSTING AND APPLICATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF OUR SERVICES.
11. Indemnification
You agree to indemnify, defend, and hold harmless Digital Web Hosting and Applications, its officers, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the services, your content, or your violation of these terms.
12. Changes to These Terms
We updated these terms periodically. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the services after such changes constitutes your acceptance of the new Terms of Service.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Digital Web Hosting and Applications is principal office is located. Any disputes shall be resolved through binding arbitration or in the appropriate courts of said jurisdiction.

Services Provided
Digital Web Hosting and Applications provides high-performance web hosting, application development environments, and technical administrative support services designed for enterprise-level operations and small business scaling.
Customer Responsibilities
Customers are responsible for maintaining the security of their applications, managing their own content, and ensuring that all users authorized under their account comply with these terms. You must provide accurate contact information and respond to security notifications promptly.
Prohibited Activities
The use of our infrastructure for illegal file sharing, hosting of pirated material, crypto-mining, or any activity that degrades the system performance for other users is strictly prohibited and subject to immediate action.
Payment and Billing
All services are billed Monthly or Annually in advance. We accept major credit cards and verified digital payments. Late payments exceeding 5 business days will result in an automated service hold.
Suspension and Termination
We reserve the right to suspend accounts for non-payment or violations of our Acceptable Use Policy. Upon termination, users have 48 hours to request a final data export before permanent deletion.
Limitation of Liability
Digital Web Hosting and Applications is not liable for data loss caused by user error or third-party exploits. Our total liability is limited to the amount paid for the service during the preceding three months.
Service Availability
We strive for 99.9% uptime, but scheduled maintenance and unforeseen upstream network issues may cause temporary interruptions. We will provide 24 hours notice for scheduled downtimes whenever possible.
Changes to Terms
We may modify these terms at any time. Significant changes will be announced via email and will take effect 30 days after notification.

Resource Usage
Users on shared hosting plans must ensure their resource usage (CPU, RAM, DISK I/O) stays within reasonable bounds and does not impact other tenants. We reserve the right to throttle or move over-extended accounts to dedicated environments.
Enforcement
We employ automated monitoring and manual audits to enforce this policy. Actions taken may include warnings, service suspension, or permanent banning without refund.
